1. KIPO expanded the service of providing information of foreign IP rights to support strong patent creation

- KIPRIS, an IP information network, expands to include Japanese patent publications and provides the search using Korean.

Since September 2014, the Korean Intellectual Property Office (KIPO) has expanded the search range of Japanese patent documents to include Japanese patent publications and provided a function enabling the search using Korean through the KIPRIS (www.kipris.co.kr) which is a nationwide search service of intellectual property (IP) information. KIPRIS now provides a search environment making it easy for anyone to find foreign prior art materials before filing applications. KIPO also plans to expand the range of bibliographical matters provided in the list as a result of search.

Previously, the search range of the Japanese documents provided by KIPRIS was only about 9,690,000 English versions of abstracts of Japanese patents and there was an inconvenience to do the search since the inputting search words had to be in English only. However, at this time, KIPO additionally provides 15,560,000 Japanese patent document data, to provide the environment such that users can directly search Japanese patent publications. As well, KIPO makes it possible to search in Korean, to improve the accessibility to Japanese patent information.

When the accessibility to foreign IP information is improved, this helps in faithfully performing prior art searches and the reasons to obtain a patent registration is clearer by preventing double patent applications from filing and by designing around a patent. Further, since it will reinforce the right of a patent as registered, the improved accessibility to foreign IP information is expected to greatly contribute to the strong patent creation.


2. Innovation of smart phones towards a curve surface over a flat surface

- The number of patent applications related to flexible smart phones rapidly increased for the last two years.

While the chase of the second movers is strong in the smart phone market, Korean companies are attempting the innovation of smart phones in a soft curve shape by breaking from the existing flat shape. Following the smart phones in the curve surface shape which were launched in October and November, last year, the smart phones applying a flexible display has launched in September this year, attracting people¡¯s interest.

According to KIPO, the number of patent applications related to flexible smart phones which had been under 40 before 2011 was 120 in 2012 and 110 in 2013, showing a big increase during the last two years.

The technology related to a flexible display which is one of core components of a flexible smart phone has been developed a long time ago. However, there are many tasks to technically solve before the flexible smart phone can be realized.

In order for a flexible smart phone to be bent on the whole, the other components, such as electronic devices, batteries, etc. inside need to be designed to be adapted to be flexible. If a screen is bent, since the distortion of an image may occur or the readability of text may deteriorate according to the direction of a user¡¯s eyes, the correction of image signals proper suitable for the bent screen is needed.


3. In the LED industry Act 2 of patent trial battles has been begun

Patent trial battles being recently developed have begun extensively and simultaneously all over the world. Further, the levels of claiming high compensation amounts for damages have increased, aiming at the ¡®prohibition of sale¡¯ against an opponent. Specifically, as global companies have been pushed by the fast chase of second movers, such as China, Taiwan, etc., the patent battles against those second movers tend to be actively developed.

According to the relevant industry, the patent trials among the global companies have been rampant in the LED package and lighting markets.

In the package field, typically Nichia, a Japanese company, has spread an infringement trial battle related to a white LED patent against Everlite, the biggest Taiwanese LED package company. Although a verdict of prohibition of sale and discard was already made in Germany, in April Nichia additionally brought an LED chip trial against Tachiban Eletech selling Everlite¡¯s products in Japan. In June, Nichia also brought a trial concerning a yellow (YAG) fluorescent substance/phosphor against Arrow in Australia.

In the lighting market, Philips recently raised a patent infringement trial related to an LED lighting module and a driving part against JST Performance. GE Lighting is also engaged in a trial related to an LED bulb before TCP of the US.

Especially, Seoul Semiconductor has run into the trial battles to drive technology protection. This company recently raised the respective patent infringement trials against Curtis and Craig, North American TV manufacturing companies. Seoul Semiconductor argued that these companies infringed a total of seven patents throughout the overall processes of epi, fab, package, lens and backlight unit system, etc.


4. Let¡¯s enhance a company¡¯s competitiveness by patent information

- An international PATent INformation EXposition (PATINEX 2014) was held.
- The global companies including Huawei, Solvay, Goole, 3M, Samsung Display, etc. introduced specific patent strategies.

According to KIPO, PATINEX 2014 was open with the subject on value chains of a company and strategies to use patent information (¡°Gaining the Competitive Edge with Patent Information¡±) in Imperial Palace Hotel, Seoul, Korea.

The global companies including Solvay, Google, 3M, Samsung Display, etc. presented the recent IP trends and effective patent management strategies by industrials and further introduced the advanced cases regarding reasonable license strategies using patent information.

Additionally, experts¡¯ lectures were performed regarding various subjects:
- concrete value evaluation methods of patents
- effective use of patent information in a trial process
- patent business strategies, etc.

In a separately arranged exhibit hall, participants can directly experience a diversity of patent information services provided by 20 domestic and foreign patent information service companies and agencies, WIBS, ANYFIVE, LexisNexis, Systran, IPtizen, Questel, ED Research, Wisdomain, etc.
