1. The KIPO budget for 2012, 405.4 billion Korea Won, is an increase of 11.6%

The Korean Intellectual Property Office (KIPO) announced that the budget for 2012 would be 405.4 billion Korea Won, showing an increase of 11.6% in comparison with 363.3 billion Korea Won for 2011.

In the budget for 2012, the KIPO¡¯s major work, such as high quality examination/trial services and creation/protection/use of intellectual properties among others, is 221.9 billion Korea Won, showing an increase of 8.1% in comparison with that for 2011.

The major work budget classified by sections is as follows: 53 billion Korea Won is for providing and supporting examination/trial services and 43.6 billion Korea Won is for information projects including 7 billion Korea Won for developing a 3rd generation patent network system.

As the intellectual property policies including the fundamental law for intellectual property and the Presidential Council on Intellectual Property established in July this year are carried forward on the governmental level, 96.9 billion Korea Won will be invested in strengthening the basis of creating intellectual property. This amount includes 33 billion Korea Won for improving R&D efficiency by strengthening the use of patent information, 24.2 billion Korea Won for enhancing local intellectual property competition, and 18.2 billion Korea Won for training intellectual property personnel.

The budget for next year will be finally decided through a process of consideration by the National Assembly.

2. According to KIPO, the filing of patent applications related to the augmented reality technology is active

It is noted that the technology related to the augmented reality to show one image by combining the real word as the eyes see and the virtual digital information has been actively developed.

On October 19, 2011, KIPO announced that the number of Korean patent applications related to the augmented reality continuously increased during the last five (5) years (2006~2010). By years, the number of the relevant applications was only 9 in 2006 but it steadily increased to 26 in 2007, 34 in 2008 and 56 in 2009. Specially, 318 applications were filed last year, showing a rapid increase of more than five (5) times in comparison with that number in 2009. In the first half of this year, about 100 applications have been already filed.

Such an increase is considered as resulting from the fact that the development of the augmented reality technology using smart phones has been accelerated as the supply of smart phones has rapidly increased. Since a camera and GPS, etc. are included in a smart phone, the smart phone has the optimal conditions to realize augmented reality.

In the Republic of Korea, there are provided services, such as ¡®ineedcoffee¡¯ showing the direction and distance of a coffee bar on the real image, ¡®arPharm¡¯ showing the direction and distance of a pharmacy, and ¡®Bus stop¡¯ showing the location and information of a bus station.


3. KIPO and the Cultural Heritage Administration (CHA) mutually cooperate to protect the traditional cultural heritage

KIPO and CHA jointly held a seminar in the government complex in Daejeon, to protect the traditional cultural heritage and to solve the pending issues of intellectual property rights.

The issue that a patent right as an individual monopoly exclusive right came into conflict regarding the traditional cultural heritage as the public property to be passed down to the descendents has been on the rise.

The seminar where the concerned parties of KIPO and CHA attended was held to discuss the intellectual property issues occurring around the traditional cultural heritage. In the seminar, the recent pending issues regarding the intellectual property rights were discussed, focusing on the patent disputes of the heritage skills and the transmission of the traditional cultural heritage by the Cultural Properties Protection Law.


4. To more easily understand patent litigation..

- KIPO published a revised version (10th edition) of the litigation manual

The Korean Intellectual Property Tribunal (KIPT; Chief Judge: CHO, Yong-Hwan) announced that the litigation manual was revised to maintain the consistency and fairness of the patent litigation and to be more easily understood.

The litigation manual as a guide of working-level procedures of patent litigation is a necessity to inform the parties and patent attorneys directly involved in a trial in addition to KIPO trial judges of the procedures of trials. This revised version has added the amended contents of the law and it has put emphasis on the unification of the sentencing/ruling and the activation of oral hearings to justly and correctly settle disputes.

Further, this revised version has added the precedents mainly consisting of the rulings/decisions of the Supreme Court and the Patent Court since the Patent Court was established in 1998. The old precedents to the same effect has been assigned their precedent numbers so that the flow of the precedents can apprehended at a glance.

The Chief Judge of KIPT said that as this revision of the litigation manual maintains the consistency of the litigation results and enables the concerned parties and patent attorneys of a trial to easily understand the litigation, the satisfaction of litigation results is expected to be enhanced.
