1. The Korean Intellectual Property Office (KIPO: Commissioner: Jung-sik KOH) and the World Intellectual Property Organization (WIPO) jointly held the ¡®WIPO regional training program¡¯

KIPO and WIPO jointly held the ¡®WIPO regional training program¡¯ regarding the ¡®Technical Transfer in the Energy Field and the Successive Technical Licensing¡¯ in the International Intellectual Property Training Institute for five (5) days, from October 19 to 23, 2009.

The middle-management technical managers from research institutes and companies from ten (10) countries (including India, Thailand and Vietnam, among the others) and legal experts specializing in technical transfer attended the training program.

This training program included lectures and discussions, based on the ¡®common challenge and solution in the technical transfer of advanced countries and developing countries¡¯ and the ¡®climatic change, cleaning technology, energy issue rising in relation to renewable energy, and regional cooperation¡¯, to solve the energy problems that are now being faced. Additionally, the attendees were divided into small-groups which were in actual training for ¡®successive licensing negotiation¡¯.

Through this program, the attendees are expected to improve the negotiation skill of the ¡®technical transfer and technical licensing¡¯ between the countries or the companies and to improve the capability of efficiently implementing the ¡®technical transfer agreement¡¯. Through the human network construction and cooperation among the countries, they are also expected to help one another in solving the energy problems that the world has been undergoing.


2. Among the patent applications of the next-generation memory, the most applications are related to the phase-change random access memory (PRAM)

While the competition is keen to develop the next-generation memory to solve the drawbacks of the existing flash memory, DRAM and the like, PRAM is the most active in the filing of patent applications.

PRAM is a memory device to store/write and read information, depending on whether a phase-changing material becomes a crystalline state of low resistivity or an amorphous state of high resistivity when the material is electrically heated.

According to KIPO, the number of Korean patent applications related to PRAM was 204 in 2008, which has a little decreased due to the economic slump, compared to 223 patent applications in 2007. However, the number of the PRAM-related patent applications is overwhelmingly high, compared with the number of patent applications related to the other next-generation memories (20 FeRAM-related applications, 53 MRAM-related applications and 66 ReRAM-related applications.)

By applicants, Hynix filed 148 PRAM-related applications (72.5%), Samsung Electronics filed 37 applications (18.1%) and the Korean research institutes including Electronics and Telecommunications Research Institute filed 9 applications (4.4%), and the foreign companies including Micron Technology filed 10 applications (4.9%). From this report, the Korean companies filed the most of the PRAM-related patent applications.

Samsung Electronics and Hynix which are leading the Korean PRAM research have focused their efforts on securing the basic technology, through the technical cooperation with Numonyx and Ovonyx which is a company holding the PRAM original technology. Since Samsung Electronics has, at last, started producing PRAM in September 2009, the commercialization of PRAM is expected soon.


3. The examination of the patent applications filed by Korean applicants is faster in Russia

In Russia, the patent applications filed by Korean applicants will be speedily examined through easy and simple procedures.

On November 1, 2009, KIPO announced that a patent prosecution highway (PPH) trial program between the Republic of Korea and Russia would be in operation from November 2, 2009.

Under the PPH, when the same application is filed in both countries and the application is registered as a patent in any one country where it has been earlier filed, it is promptly examined in the other country, based on the examination results of the one country.

KIPO has been operating the PPH with a total of six (6) countries, i.e., Japan, US, Denmark, UK, Canada and Russia.

The Korea-Russia PPH trial program will be operated for one (1) year. The detailed matters thereof will be provided at KIPO homepage (www.kipo.go.kr).


4. MS-ZONE won two (2) trial cases filed in the Supreme Court of Korea against RYN Korea

On October 20, 2009, MS-ZONE, a company specializing in functional footwear, announced that they won the patent and design infringement trials which were brought by RYN Korea ([ ]), known as ¡°¸°ÄÚ¸®¾Æ¡± ([rin ]).

According to MS-ZONE, RYN Korea filed the two trials, arguing that the functional footwear produced by MS-ZONE infringed the patent and design owned by RYN Korea. However, the two trials had been dismissed in the Supreme Court of Korea, and it has been decided that the plaintiff lost the trials.

¡°RYN Korea brought six (6) trials on the patent and design infringement to the Patent Court but MS-ZONE won all the trials,¡± a spokesman of MS-ZONE added.

¡°Only the costs for the trials were 120,000,000 Korea Won. Moreover, we could not do any normal company activities meantime.

Since the leading company [MS-ZONE] interrupted our company [RYN Korea] which was delayed entry and advancement in the market place, our clients were also damaged,¡± the spokesman explained.
